Terms of Service

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract under Indian law to use the Service. By using the Service, you represent that you meet these requirements.

2. Accounts

Your society or its administrator may invite you to join the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at contact@nivaso.space if you suspect unauthorized access.

3. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not:

• Use the Service in violation of any applicable law or regulation.
• Upload, post, or share content that is unlawful, defamatory, harassing, obscene, or infringes the rights of others.
• Attempt to gain unauthorized access to other accounts, societies, or our systems.
• Reverse engineer, decompile, or attempt to extract source code from the Service except where permitted by law.
• Use the Service to send spam, malware, or any harmful content.
• Misrepresent your identity or affiliation with any person or society.

We may suspend or terminate accounts that violate these rules.

4. Society administrators & roles

The Service is configured by your society's administrators (e.g. committee members) who define roles, permissions, and module access. We are not responsible for decisions made by your society administrators within the Service, including who is added or removed, what data is published, or how dues are calculated.

5. Subscription, fees & payments

Some features of the Service may be offered free of charge while others require a paid subscription by your society. Pricing, billing cycles, and payment terms will be communicated to the society at the time of subscription. Payments are processed by third-party gateways and are subject to their terms.

Unless otherwise stated, fees are non-refundable except as required by applicable law or as expressly provided in a separate refund policy.

6. User content

You retain ownership of content you submit through the Service (notices, photos, complaints, messages). By submitting content, you grant Nivaso a non-exclusive, royalty-free licence to host, store, transmit, display, and process that content solely for the purpose of operating and improving the Service for you and your society.

You are responsible for ensuring you have the right to share any content you upload, including visitor photos and personal information of others.

7. Intellectual property

The Service, including its software, design, branding, and content (excluding user content), is owned by Shivarth Softtech LLP and protected by Indian and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service strictly in accordance with these Terms.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.

9. Service availability & changes

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also update these Terms — material changes will be communicated through the app, website, or email.

10. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by applicable law, Shivarth Softtech LLP and its partners, employees, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of these Terms shall not exceed the amount paid by your society to us during the twelve months preceding the claim, or INR 5,000, whichever is greater.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. On termination, your right to use the Service ends immediately, but provisions that by their nature should survive (intellectual property, limitation of liability, governing law) will continue to apply.

13. Governing law & jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat.
